Visa enquiry

I am in the US on B1/B2 visa. I am engaged to a US citizen and we want to do a registered marriage. After that is done, what is the procedure to obtain a visa/greencard? Also how long does it take?
According to the information that I have, I understand that after the registered marriage is done, there is an interview which follows. Since I can stay here only till mid February, I was wondering how long this process would take. That is, approximately how soon would I get a date for an interview. Does it require submission of passport later on? If so, when would it be returned back to me? I would really appreciate if I could get info regarding the above asap. Thank you.

Re: Visa enquiry

You and your spouse need to send the INS District office in your area the I 130 and the I485 / I765 / I131 papers along with the necessary information before your authorized stay I94 expires.

You can find all the necessary information on the INS website at http://www.ins.usdoj.gov (click on the forms link to download all the necessary forms)

The time frame to get your AOS processed depends on the district office and can vary from 6months to 2 years.

The INS will call you and your spouse for an interview before your application is adjudicated. You donot need to submit a passport but you will have to take it to the INS office whenever asked for.

Once your application has been submitted with the INS you can legally stay in the U.S. till your application has been adjudicated.

Hope this helps and feel free to ask any questions if you like
