To All Gurus...,
I know its an often repeated Q... I am a green card holder planning to get married to a girl in India. Is there a way I can bring her here after Marriage? Can she come over here on a F1 or a H1 visa? How long would it take if I were to apply for her GC? How do I go about it? Has anyone had success...in such a scenario...!! One last Q...is it better to apply for her H1...or F1..and marry her once she comes over here? Greatly appreciate all your comments..and opinions!! Thanks, R.

One of my friends has a different situation. He married a woman
outisde the USA while on I-485 pending. The wife just got her H-4 after _FIVE MONTH_ sinde the filing application. She will come soon. But he worries now what would become of his wife's status if he suddently get his I-485 approved before filing his wife's. You know if his I-485 is suddently approved, then he lose his H1B status, which also means (1) his wife's H4 visa become invalid automatically if she has not come ot teh USA or (2) his wife would lose her H4 status automatically if she is here. |

Marriage After Green Card!!
Hi Gurus...
Has anyone here on the web...got married to an Indian after the GC? Are there any instances of positive results...for an Indian Girl married to a GC holder in obtaining a H1B Visa (Assuming valid credentials) Could U share your experiences, It would be invaluable to many in similar situation. Trouble is that the wife, figuring this means she is moving to
the USA permanently anyway, want to say in hoem country as long as the curent visa allow. My friend fears that if his I-485 get approved tomorrow, his wife may be stopped at the port of entry if the INS run a check and find the husband got the GC, which made H4 valid. Even if the INS does not stop teh wife, would the entry considered illegal in teh future in retrospect? Follow to join can only be done with I-485 but not CO, correct? |

Check out http://www.ins.gov/graphics/howdoi/A....htm#Following for information regarding the following-to-join process. If your friend becomes a permanent resident before his wife enters the US, she can still become a permanent resident fairly quickly by having her immigrant-visa interview done at a US consulate in her own country. I am not sure how long the INS takes to process form I-824 and inform the consulate that the petitioner (your friend) is a permanent resident but I am fairly certain it will only be of the order of a few months.
