Filed I-130 for my sibling. Now what's next?
I sent out I-130 petition for a sibling. According to online tracking info, it arrived at Chicago lockbox on June 22, 2009. What shall I do next? When do I expect to hear from USCIS?

Wait a few years.

I-130 approval could be 3-5 years. Green card for your sibling around 12-15 years.

What's the difference between approval and green card? Does it mean that it'll be at least 15 (3+12) years before he can come to the U.S.?

the processes run simultaneously. Approval may take any time, but it doesn't matter much as long as the priority date is not current. Do a search on the forum with words priority date, current and visa bulletin.

It is not surprising that the Sibling Cases take 10-15 years to be completed. I am a USC and weighing the sponsorship options for my brother. Hopefully this will get better if they enact Comprehensive Immigration Reform as envisioned by Democrats in Congress.

it will not get better. It will get worse. They'll give GCs to all the illegals, and legals will have to wait for 20-25 years instead of 12-15.

Your sibling is looking at 12-15 years before joining you in the US.

Since they got it on June 22, 2009, I should get a receipt anytime. Is that correct? I just want to make sure I don't miss anything in the long process. |

Just wondering, if he files for his brother, and his father will also file for the son after getting own gc, what will be the PD for dad's petition? The day dad filed, or the day brother filed?

The other advantage of the FB4 petition is that it keeps things alive if the brother gets married, which would void an FB2 petition.

Also as mentioned, if my brother marries, that may invalidate my father's petition. Of course I can take over once my brother marries; however, I'm concerned that switching between me and my father may mess things up. |

Would there be any benefit if I file an I130 for my brother right now? |

If your brother gets married in the middle, your mother will no longer be eligible to be his sponsor. You'll then have to file I-130 for your brother. That'll mess things up. |

He will not get married in the mean time, I can say that for sure. Given this - Would he benefit from my petition? |

Of course. Your mother's petition would be automatically voided when he gets married. Yours would not. Additionally, you can file for him now, your mother cannot.

Thanks TRC. But once again, I am not worried at all about him getting married before he gets the card.
What I am asking is about the priority date. If I apply now, would it be possible for him to use the PD date from my petition once my mom applies for him. If yes, how? |
