GC for Parents - Urgent !

I am a US citizen.

I would like to file GC for my parents and sibling who are currently in India.

My qtns are -

1. Can I file GC ( forms I -130 and I -485 ) at the same time simultaneously for my parents once they are in the US on a B1/B2 status ? Wht abt siblings ?

( Is I -485 for adjustment of status?)

2. Can my parents travel back and forth from US to India while the GC application is in process?

3. If I apply for GC ( I 130 and I 485 )when my parents visit US next time - Can my parents stay beyond their permitted period (I-94) till the process is over?

4. How long does it usually take for the entire process within the US ?

You can file for your parents everything same time and they can stay in US while everything is in process. I've heard from number of people that it's better to stay in US and wait for GC, but frankly if there are no complications in case and they get AP, they can travel.

As for siblings you can only file I-130 for them with 10+ years of wait.

1. Yes, but bare in mind that it is considered fraud to enter the country on a non-immigrant visa with the intent of immigrating.
2. Yes but I wouldn't recommend it for the above reason. You take a chance of them not being allowed back in the country.
3. Yes. You are in legal status when your case is being processed.

08/27/2009: Interview with no answer !!
08/28/2009: Card production ordered.. woohooo...

The intent to immigrate has been established already. Go the CP route and not the AOS route!!!

Your parents can get approved to move to the US in 6-12 months, but the sibling category has an 11+ year waiting line.
