Rfe.....

help pls
my hubby applied for I 485,I765 and I130 in january with NOA on 1/26/. did my fingerprints on 2/13.had an infopass appoint on I765 today IO told me the 90 days restarts whenever one get RFE and since my bio was received on 2/20/09, the 90days is not due yet....how disappointed cos i need to work since am broke and my hubbys income is not enough..now my question if i shd get another RFE will that mean i will be starting all over again?
also my 1st lawyer got federal appointment so transfered us to a new lawyer after filing everything, since its taking a longer time than i expected to get my EAD, ..was thinking of droping our lawyer and continuing urselves since the legal fee is really becoming a problem, will that cause any problem and which form shd i fill and will that start the whole process again? pls i need your advice

Don't pay too much attention to what those people tell you. Your EAD is probably going to take the normal 90 days. Don't sweat it ok. Just wait it out patiently.. too much information can be a source of pain.

You really don't need a lawyer with a simple filing, when you have people on a forum like this with lots of experience. Drop that lawyer and save money.

thanks for ur encouragement myredskins, but the 90 days has passed already ie last sunday 4/26....but still no EAD, i ve a lawyer all along but we have to drop him now since we cannot afford him.
which form do we file to inform uscis that my hubby and i will be doing it urselves

I don't think you need to send them any form but if you want to, just send them a letter with your receipt number.

I don't think you need to inform USCIS when you stop using your lawyer, call them to find out just in case.

Here is what is not clear. Did you pay your lawyer a one time fee, for the entire period or what? How do you pay this guy? By that I mean how often?

he charged us $2200, we paid 400 for retaining in oct and we were were suppose to pay $200 each mth till i get my GC or we finish paying the $2200.we paid $200 in november, and since then we have not been able pay again....so its piling up each mth till now.
that was our 1st lawyer b4 he transfered us to a new lawyer.....with the contract being the same....
since its now been filed already we were thinking of droping him....so we pay only up to this mth cos its becoming very difficult for us

Depending on what information they are requesting for, i also have an RFE and i called the customer service center about my EAD and was told that it will only delay my application process for i-485 but will not affect my EAD process.

So do call the customer service center and they will give you information on that. And RFE is not for you to start all over, it only delays the process, but it will continue as long as you submit the information within the time frame given to you.

Write your lawyer a letter and also inform USCIS about the change that is all, Lawyers are only necessary when you have a complicated case, but if your case is staright forward you can do your filling yourself and if you get confused at any stage call teh customer service help line they will put you through what to do, that is what i did and trust me it works, because ppl have a way of distorting and rephrasing information according to their understanding.
