f2b currently pregnant.. need some info...

i am currently pregnant and due on april 2009... unmarried, my question is.. can i bring my child if ever my PD becomes current? my parents filed the petition nov 2002, by the way im from the philippines. whats the timeframe for this category? any info regarding my case.. pls!

The cutoff date for F2B is in 1997 for the Philippines. So your child will be a few years old before your 2002 priority date becomes current. I don't think the child can be added to the petition (I'm not sure of this though, let's wait for others to comment); you probably will have to file for the child yourself after becoming an LPR, and wait out the 4-5 years while your child is in the Philippines.

The PD for your country is in 1997, so there's probably another 5-7 years to wait. Don't get married until you get your GC or your parents naturalize.

I don't see why not. It's not a common situation, but I'm not aware of any restriction on derivative beneficiaries in FB2B, or FB1.

Well, the F2B already has the obvious restriction against a derivative spouse. The apparent intention is that only the LPR's child is immigrating, not anybody else.

There is a lawyer who specializes in Filipino legal issues. Look for Gurfinkel; I believe this was discussed in his updates; you may have to look at several years worth of postings.
