Can I file for I-751 If my Divorce is pending?

Hi everyone,
I have 2 questions:

1/- I filed for divorce on October, 2007 and my next hearing is on 2010. So, I'm supposed to apply for my I-751 GC on february 2009. Can I do it still? Do I need a lawyer?
Our marriage just didn't work out and we agreed to file for divorce.

2/- Since things didn't work out I moved to Canada for grad school to clear the air and take a break from all the drama. I used to cross the borders (vermont) every 6 months of my stay in canada as a US permanent resident student in canada ( I entered Canada thu my GC). Well, I stayed for 8 months now in Canada because I got caught up with finals and just tons of school work. Can I re-enter the US now still? Or, do I need to apply for a re-entry permit?

I will really appreciate any helpful input guys Thanks!

You cannot apply for a re-entry permit outside the U.S.
