Unemployment on EAD and AP (Marriage based GC)

Hello,


Tomorrow is my last day at work. I am losing my job because of company's new cost-cutting strategy. After doing some research, I found that EAD will make me eligible for unemployment benefits. But I want to make sure that if I claim this should not go against me during my interview. My wife goes to school and we showed my full-time job's salary for I-824.

During interview they may raise questions on this which is scary. Any idea guys? Am I eligible?

Claiming unemployment benefits is not considered as getting government handouts and therefore in itself is not a disqualification for your pending GC application.

The bigger problem you have is that your wife who is your GC sponsor and who has signed your affidavit of support does not have a job. If you lose your job then the I-824 you submitted is sort of meaningless. Do you have any other investments/savings that can satisfy the requriements of I-824? If not, your GC application might be in trouble.

To be on safe side don't claim unemployment benefits until you have gc in hand

oh, please, that's just stupid. If the person is eligible for unemployment benefits, by all means - claim it. It's an insurance for which your ex-employer paid - use it. It's not welfare or public benefits.

I agree with you Lucy. But they may ask weird questions in interview which I want to ignore.

I'll wait for a week or so and still if I dont find any job, I'll go for it.

they ask if you ever got or plan to get welfare, but they never ask about unemployment insurance.
