The Process Begins

I am a US born citizen. My wife is from Mexico. We were married in Las Vegas in 2005. We have two children, age 3 and 9 months. I met her in Arizona in 2004, she still has her visitor visa that expires in 2012. To date we have done nothing in regards to her residency. I guess because we did not feel that the chance of being denied was worth the risk. We have ehard so many different stories and have followed the news, hoping that the process would somehow be easier.

To this point, we have always considered living in Mexico. What I was not aware of was the fact that if we do go back, it may become very difficult for her to return to the USA. This is something we do not want to risk.

So the process begins. I am planning a trip to the local immigration office in the morning to begin the process. I am going to go in blind, and ask for assistance. We can not afford an attorney, I am going to have to do this on my own, maybe with some help for all of you.

I've combed the net for cases like ours and found most to be uncomplicated. The only issue that we have is that she never obtained permission to go beyond Tucson for a shopping trip. I would imagine that this happens often.

Please help.

Did she use her visitor visa to enter? was her passport stamped? is there a form I-94 stapled in her passport? how long ago did she enter?

ps: Just because her visa does not expire until 2012, that does not mean she is OK... her "authorized period of stay" expired a LONG time ago.

hi
if she enter to USA legally even if she overstay, marriage petition is forgiven so you will filed I-130 to petition her along with I-485 that include I-693 (her medical examination check surgeons near to you on web site Uscis.gov) along with I-864 (affidavit sponsor (you)if you reach th e%125 to provide for her or you may need a co-sponsor , them I765 for her work permit EAD all together send two check of $355 For I-130 and $1010 for I-485, I-765 is include also if you want to apply for advance parole is I-131 which is included in I-485
I did filed my paper myself
you can find these form in uscis.gov under inmigration form and download them

there is no need to go to the USCIS office personally either. All the forms are available online and have instructions.
