starting a company after getting a green card

Hi,

Does it impact in any way citizenship eligibility, if you start a company after getting a green card instead of working for the green card sponsor beyond 6 months period time ?

Go ahead and start you own company! All the best!

Even when a person is on EAD, he can start his own company and port to self-employment on a same or similar job under AC21 provisions!

Not so simple. You should expect to have equally as much trouble with obtaining citizenship as others who left their employer as quickly as you (whether they changed to a new employer or started their own company).

While technically true, it is not doable for most. Self-employment with EAD for AC21 purposes is viewed very suspiciously, and USCIS would expect the company to show enough revenue and/or investor funding to pay the salaries and other expenses. In addition, the duties involved with running a company usually are very different from being an employee, thus making most such situations NOT considered "same or similar" for AC21 purposes.

Generally speaking, this means that they are working on a 1099 basis with a US entity, doing something similar to the LC job.
