Some bad new from Newark local INS office

One of my co worker’s petition in EB3,Inida, PD Nov 2002 got approved in Nov 2004(Just before the ret rogation ). But his wife’s petition was pending and transferred to Local office in Newark(NJ) last year. Eight months before they had an interview in local office and were told that every thing was fine and ready for approval when ever the visa number is available.

They had an info pass appointment today morning. The officer told him about the non availability of visa number for EB3 since June 13th. He advised him to come on October.


I guess all the service centers are pre allocated with some visa numbers.
TSC started approving June 1st and no much approvals as of right now.
NSC from June 18th . I don’t know how long this will last?
CSC & VSC no much activities as of now.

I remember, CSC & VSC were so active in the year 2004 just before PD retro gating. They must have already cleared pretty good number of cases in the year 2001, 2002. Will they be active from July 1st?


For approval, do we need to consider the total number of visa number for a family?
Based on my friends and co workers approval trend, I think if you are from ret rogation
Country and need more visa numbers, you should wait long enough to get approval then others.

CSC and VSC no longer process 485s (bi-specialization program) - that is why there is no activity from them.

You are the 2nd or 3rd person to report the "visa number running out" scenario from Infopass appt in NJ.

could this be because the local offices have different quota allocated than the service centers? or is it true that other service centers are done with ther quota but since nebraska started late there could be some more lucky ones.

well...explanation makes some sense in conjunction with what we are seeing for last couple of weeks...

but nonetheless it all sucks...no clarity...all confusion...

I would say - contact your congressman and senator - if you want to confirm that Visa Numbers in EB3 have been exhausted....

The general impression has been that 40K to 70k visas are left over....due to non-usage of ROW...I doubt India/China could consume so many numbers so fast...because traditionally, India's demand has been only about 40K per year...


INFOPASS REPS - don't trust them blindly....sometimes, they are a bunch of idiots....I remember, the TSC reps told me like 1 year back, that my wife's I485 got approved when she got the "Document sent" mail....They are just dumb....

THINK OF IT...IF INFOPASS REPS KNOW THAT VISA NUMBERS HAVE BEEN USED UP....AILA WOULD ALSO KNOW IT...AND WOULD HAVE WARNED EVERYBODY/ALL LAWYERS BY NOW....

I remember when H1B quota got used up in 05, AILA did inform lawyers 1-2 days before that they are used up...

Folks...

Banta is right in many ways...Do not trust Infopass crap...We will know about visa number in July Visa Bulleten. But one thing is sure the Visa numbers are REDUCING every day!! (it is based on few posts here and one of my friend called yesterday NSC (he filed with me and coworker but not approved yet!!) and he got similar feedback that it will be less and less approval as time passes by...No one really know how much numbers left..But Keep your Hope ALIVE...

Guys: Don't lose hope. I was very disappointed seeing the above message this morning but luckily I just got my approval. I don't think numbers are over.

Don't take anything from anyone.

I just got approval emails.

I talked to NSC yesterday and they said as long as visa bulletin says its available means its available. and whoever are in que, visa number is allocated .

Friends,

Don't believe the bad news from the Infopass reps. I guess the NSC folks want to send approvals slowly every day of the month so that they can prove that they are approving cases.

Everyone of you will get the Approval. It's only a matter of a few days before you see the magic email.

Find out if the application is in staging area, if it is then it will surely be approved......i checked mine yesterday and today i got approval.....so be optimistic and don't go by rumors....

Call INS IO (refer to old post for how to get to IO) and they will tell you that if you are presorted or not. They will tell you that you are in stage area/pool , waiting to assign officer. Good Luck.

In any case there should be some visas reserved by local offices as well, apart from NSC and TSC. I am not sure when local offices start sending out approvals since this looks like a local office case now.
Like I know DC local office has not been sending out any approvals since June start..for an idiot reason that they are doing an inter-office move. I am sure they are doing thing only because they are sure that have some visas to give out. Knowingly they are not going screw up all DC local office peitions...who are current. Atleast I am hoping so!

Newark Local INS office

Hello Gurus,

Yesterday even I went to Newark ofice with Infopass appt. Officer mentioned that Jun 13 they visa numbers are done. Person in front of me when she went to the counter I heard officer mentioend it to her with loud voice.

I went to differnt counter and that lady saw my case and gave me G14 form and ask me to sit and wait. New officer called me and metioned visa numbers are done. I asked Mam my interview is done last year June 06 and also I asked her to check my name/backgrond check. She checked and said your background check is through and pending for approval. She also mentioned me I can try putting a service request on my case.

My details are:

PD : Aug 02 EB3
I140 AP in Jun 2005
I485 transfered to local office in Oct 2005
I485 interview done in June 06.

I know this sounds scary to lot of people no visa numbers. But I wish to every one who are strugling should get there Gc... including me.

Hate to say this..but your I485 date is Oct 2005! Based on my various calls with INS IO, they will go by I485 RD not by PD (you will see random approval too!!). But they will go through 02/03 and number of 04 cases before even they get to 05!! The only hope is your PD is Aug 02!! If you are lucky guy, you can get the CARD!!

Call INS IO to find out your case is presorted and seating in STAGING AREA (Waiting to assign IO). You can reach them by following...

1-800-375-5283

Press the following in the order given below

1-2-2-6-1

it will ask for Lin #, following Lin # press 1
listen to all the automated messages - then press option 3 when the message gives you more options, and then immediately press 4.

GOOD LUCK...

(My case has been approved but due to few of my freinds request, I am still part of this forum to give any info to help our Bro...I will be sign out soon though...thanks)
