No birth cert but secondary proof, cannot get sworn affidavit from anyone older
This is regarding substitute for my parent's birth certificate. Both of them have their "school leaving certificate" with DOB on it. But we cannot back it up with sworn affidavits from anyone older than them. They are old themselves and it is almost impossible to find relatives who are older.
Since they have a secondary proof of DOB and it is next to impossible to get two sworn affidavit, what do we do to meet USCIS/DOState requirements? Mahesh |

I'm in the same boat as you. Give the USCIS as many documents as possible and hope for the best. I'm awaiting a ruling right now.

I submitted an affidavit that outlined my difficulty in obtaining the birth certificate. Include the reasons the birth certificate is unobtainable and indicate that you celebrate their birthdays on the date in question. If you've contacted the Indian government or consulate, outline your efforts. That's what I did. If by some fluke you've gotten letters of rejection/unavailability from the government then submit those too. My father is ready to be scheduled for the interview but my mother is still awaiting a rereading and review of the documents, so I've got my fingers crossed. My mother has old British and Canadian passports, Indiana Drivers License, IU documents and my brother's b/c from Monroe County IN has the age of the parents at his birth. My parents were married in both a religious ceremony and a civil ceremony. The civil ceremony was in Indianapolis and the religious one was in Chicago. The age is given on the religious document. My mom was a student at IU on student visa so I requested documents from the USCIS folks under the freedom of information act but have received anything yet. I only hope this is enough.

Birth certificate for my wife
Hello,
I am also in the same situtation where my wife does'nt have her Birth certificate. But we have her indian 10th class marksheet and her P.G certificate which shows her date of birth. Are these documents enough to prove as secondary evidence. If so how do I mention to them while appling for her GC Thanks tvklovesu

You need to swear out an affidavit outlining your experiences. Have your wife swear one, the more affadavits the better. I have included the procedure in another post. The USCIS "readers" make a determination of whether or not you have enough documentation so it is in your best interest to include every document you have.
