**** Urgent H1b Cap Question Please Help ****
My Friend has applied for H1B in 2001 and approved, Unfortunately VISA is
being rejected on 221(g) in 2002 . He is trying for F2 visa now. Here is My question's to you all: 1. If he apply for H1B <from India> again will come into CAP? 2. In case if he comes here on F2, can he apply for COS form F-2 to H1B <NEW> , also will he come under the cap in this situation also? PLEASE RESPOND :

As long as he's a 4 yr Bachelo'rs degree he should be fine in applying for H1B in the coming year.
-If he comes to US on F2 Visa, it is absolutely possible for the individual to apply for the change of status. mukesh, rahasiam.com
