Green Card by marrying an U.S.citizen

I'm a Brazilian woman who came to the U.S. as a visitor but i overstayed and my visa is expired. I married an U.S. citizen last year. I want to know if i need a waiver to file for the Green Card since i'm out of status.

you are fine..

...your case is common...u shall be forgiven since you married GOD..i mean a US citizen. If you have overstayed beyond 180 days, don't even dare to visit Brazil for the Carnival while your GC is being processed (even with advance parole)...they will banish you and won't let u enter.

No waiver required. Just make sure you don't leave the country until USCIS has sent you your green card.
