Quick Question guys..

I was just wondering what is the average length of time that it takes USCIS to send out RFEs (if any) to people after receiving the I-130, I-485, I-765 package.

The reason I ask is because my lawyer was hard-headed and did not want to send proof of a bona fide marriage with my I-130 package. He said that the USCIS only asks for that once you have your interview. I told him that after January 07, you must send proof with your I-130 and he said: "This is one of those things were you have to trust your lawyer."

I dunno guys what do you think? If USCIS is going to RFE me, how long does it usually take? I know its D.O. based, but just in average?

Also can USCIS deny my case for this or just send me an RFE?

...does the lawyer charge you / hour? That might explain why he does not want you to send any proof during your application process. That way, he hopes u will get RFE'd and he will billl you more benjamins for preparing/collecting/mailing the RFE's. Nice !! The I130 clearly states that you shud send supporting doc as a marriage proof. I really don't understand iwhy folks hire a lawyer in clearcut cases. Nothing against you Espo, I dunno your case/situation, but this is DIY type of submission....save the big money for those rounds of Golf !

Btw, to answer your real questions, reading from other user's posts, RFE can come anytime after RD till the interview and happen even after interview (read the recent post about the guy who was told "we will make a decision later") and got an RFE the next day in mail after the interview.
Pray to God, you don't get RFE'd, rejection does not happen unless you have paid the wrong amount or incorrectly filled up your forms etc. RFE just adds 3-4 weeks of turnaround time, according to the people who went thru them

Thanks for the reply buddy. No he charged a flat fee of $1,400. The reason I hired a lawyer is because I didn't really understand how to fill out a lot of the forms and I wanted to be on the safe side. I am only going to be paying this once in my life (I hope) and there is no price to get a GC heh. Well, I hope I dont get a RFE, but if I do I guess its not that much of a big deal eh?

Exact same situation with me. However, I literally forced his paralegal to include the birth certificate of our child with the application.

I must say that the attorney is not entirely wrong - they are used to submitting minimal things and then going to the interview and the massive documentation.

I think you will not get rfe.

that's how...they make their dough. Make u feel that it's a HUGE undertaking :-) and mint the benjamins.. Yea, you won't get RFE...good luck, both of you.

...am not being sarcastic..just hoping that you don't get an RFE...that's all. I dunno what exactly you sent alongwith your 130, but hopefully it's enough ( you have a lawyer...so he knows better than me)
