I-864 income information if filed joint tax returns
Hi,
I am preparing to file a green card application. I am sponsored by my wife. We have been married and lived in the US for more than three years, and we have filed joint tax returns for the last three years. I have a question on how exactly to enter income (and tax return) information in the I-864 affidavit: Is it correct to enter in lines 23 and 24 just my wife's income, and in field 25 our joint income from the tax return? Thank you for your help. Niki. |

You can include both incomes, assuming you live together. As a household member your income can be used for the affidavit of support. In my case my wife earned $0 in 2005, and I earned way over the limit for I-864. As we filed joint tax return I put my income in there.

I entered my wife's income only (as this was enough), but included joint tax returns for the last 2 years, and then individual tax returns of us before marriage.
Make sure, u attach all w-2s for the sponsoring USC. My interviewer, atleast looked at them, and started asking some really dumb questions in rude tone.

Hi,
Thanks for your replies. I do not plan to use my own income, as my wife's income will be sufficient. I will definitely then enter her income in lines 23 and 24. But in line 25, do I then deduct my income, or do I use the total amount of the tax return? Or should I add a page with an explanation? Also, I assume it is ok to file the 2005 tax return, since the 2006 one is not due until April. And one last, general question: Do any or all photocopies submitted with all green-card related applications have to be notarized? Photocopies of W2s, passports, etc.? Thanks for your help. Niki. |
