I-94 Incorrect Date of Birth

Hi

I got my I-94 through my H-1B but the date of birth is incorrect on it. I guess when i will go for stamping, they will give me hard-time on this.

Please let me know how can I correc it.

File I-102 with USCIS. If it was their error (and you can prove it), then there will be no fees associated.

I-94 Incorrect Date of Birth

Thanks for your reply Saif. But how long would it take . Do you know somebody who has gone through this. One lawyer told me to file I-824. Please clarify

Processing times depend on your service center. Which one is yours?
The error is on the I-94 (need I-102 then) or on the I-797? Or is it on both?
An I-824 is used for requesting a duplicate I-797, not for correcting one as far as I know. I may be wrong however.

I-94 Incorrect Date of Birth

There is no date on I-797. The only date of birth I can see is on I-94.
They had my passport copies still they made a blunder.

Should there DOB on I-797 too? I spoke to lawyer and he said just leave the country and come back. By doing this, they will take your current I-94 and will give you the new one with correct DOB.

I want to know how risky is this. Will they (Port of Entry officials) also change my I-797 if I have incorrect DOB on I-797?

Well if it is just on the I-94 you can either file an I-102 or follow your lawyer's advice. Since there is no DOB on the I-797, there is nothing to worry there.
If you live close to the Canadian/Mexican border, take a day trip there. Surrender the typo I-94 and get a new one on your return.

I live in boston. I am thinking to get my H-1B stamp in the same occasion by going to Canada. I am planning to go in April/May 07
