Received Interview notice! but Anxiety sets in
Hey guys,
Well my step father picked up the mail today and he says he received an Interview notice (For me) for January 26th. My step-father is gone over night and tomorow I will receive the letter by hand when he gets home. Anyways, I am quite alittle nervous, ofcourse everyone on here is too but for my situation. Heres alittle info.. Nationalty:Canadian Age:18/19 My step-father is sponsering me, he is married to my mother and my mother is currently living in Canada. The reason why my mother lives in Canada is because last October 2005, my mom was still living in Canada (Couldn't afford to file papers in 2003-2004 when Married, so stayed in Canada) and she went over the border late at night to go pick up her son (my other brother who is 2) because he was staying with his father (who is my sponser). The Border did a random search and found Old U.S. Mail and suspected her as an Illegal Alien. Soon, they Banned her for 5 years and she was planning to file her papers in Early 2006 (after I graduated). I thought because of my mother's ban, USCIS would not let my Step-Father sponser me, but I called the 1-800 USCIS number and they told me that I am allowed to be sponsered and that my mother's case should not effect me. I am NOT banned but I am afraid that at the Interview they will questoned why my mother is not with me and not living in the United States, now I made an INFOPASS during my RFE missing letter situation and the Immirgation Officer told me that he has never heard of a case like mine, he says usually the Biological Parent is with the Child and the U.S. Citzen sponsers them together, but he did say that he maybe wrong. So thats why I am nervous, I am afraid they will Decline me because My mother is not present in the U.S. My Step-Father sponsered me because he wants me to get an Education, get a Job and be suportive so I can get on my own two-feet and face the Real World next summer (get my own place). I told him that I don't want to wait for my mother's ban to be up so he went ahead and filed. He will sponser my mother when her ban is up, he is right now have a lawyer to reduce her ban. I also tried looking up past experences of Step-Child/Step Parent case Interviews but there are none that I can find. I will post more information about the Letter when I receive it personally tomorow.

Your case is unusual, but you are eligible for the immigration benefit you seek. If you have the resources, taking an attorney with you may be a good idea. Note, I am not saying it is NECESSARY, but it is always a good insurance policy in unusual cases, since officers often need to be reminded of what the law is. well thank you, yeah I don't have a lawyer, but is there Lawyers out there that will come to interview even tho they weren't involved with the case being filed and stuff? Also, If I choose not to seek a lawyer, do you have any evidence (anything on USCIS) that says my right to be eligable for Immirgation benefit? because I tried looking on USCIS.gov I can't really find anything. Oh and if you have any advice on "Do's and Don't's" I would appreate it. thanks again

Your case is pretty unique, but since your father is the one who is your sponsor, should not be a major issue.
You can check with a lawyer or somebody that can review your case and give you an assestment about it. Take care, |

hmm..I guess I could call around but hopefully they wont ask for alot of money or something, cause I thought a Lawyer cant come to the interview, if they didn't do the whole case.
