changing employer after 4 months of GC

I got my GC approved on May 11th. I am still working for my employer who suppoted it on AC21. My wife's case is till not yet approved and pending approval due to VISA number availiability. I am getting a very good contract opportunity on 1099 and would boost my salary by almost 60%.

Is this advisable to switch at this point? Can USCIS come back to me asking for my employment verification when my wife's case is being adjudicated? She already had her I-485 interview done at local office back in Feb 2006 with me.

Thanks

IL_LABOR:

I mentioned about the inter-gallactic war because, the question that you've
asked has been asked by other members in the past and the issue has been
beaten to death by many members and atleast in one case a few members
have been suspended from the form.. That's why I said that..

There are NO specifics on the time you should be sticking to your GC sponsor
after getting the immigration approval. The lawyers interpret that six months
is a good time to stick with the sponsor before looking for other opportunities
as the GC is filed based on "future full time employment" with the sponsor and
leaving the company within a short span of time - after getting the approval -
lets USCIS believe that you didn't apply for GC in good faith. This MAY, I
repeat MAY affect in your citizenship application in the future if you don't
stick with your sponsor for a long time.

Having said that, some argue that six months to one year is a good time to
stick with the sponsor. Others don't give a sh*t and they move on.
It all depends on the risk the person wants to take. And there is NO thumb
rule as to the time span, according to USCIS IMHO.

But, I do know a case where one of my ex-colleagues got his GC from his
employer (my previous employer that is) and within few months we all
got laid off and he was also let go. He found a job in MSFT and worked there
happily for five years and left MSFT to do his own business. In the mean time,
he applied for his citizenship and he DID get it. He didn't have problem with
leaving the company within few months after getting his GC. I checked with
him on that and he said that he didn't face that as an issue during his
citizenship process. As a precaution, he took a letter from our previous
employer about the lay off and press releases (that comp was a publicly
traded company) in case he was asked by USCIS. And he wasn't.

So, here you go. It all depends on your future plans. You will have many
members providing you their two cents on your question. Talk to a good
immigration lawer so you don't leave no stones unturned.

Good luck

attorney is advised.
