I-485 Supplement A
I am marrying a US Citizen and going to apply for AOS from my H1b. The thing is that even though I have an H1b and I have been working, I have not been getting paid a salary with a W2 and paystubs. Does that mean I have to submit Supplement A of form I-485? The form says that if I have accepted employment without authorization or have failed to keep lawful status, I need to submit it. Does my situation qualify?
And another section states that: "If you are applying to adjust as the spouse or unmarried minor child of a U.S. citizen or the parent of a U.S. citizen child at least 21 years of age, and if you were inspected and lawfully admitted to the United States other than in C-1 or S nonimmigrant status, you do not need to file this form." I was lawfully admitted to the US and I am applying as a spouse of a US Citizen, so does that mean I don't need to file, even if I have not kept my legal status? Thanks. |

Disregard that supplement, it doesn't apply to spouses of USC's.

You don't need it! Neither do I, yay!!!
I was worried about that Supplement A form thing also, because of its high price, $1000.00! Jeez!!!
Thankfully, I found out through this website (thanks everybody!) and even a law firm's website that spouses of US Citizens are pardoned automatically so we don't need to pay this thousand dollar penalty You don't need to fill out that form, and in my case I am planning to feed it through our shredder and smile happily!!! |
