what if spouse is not here @ the time of interview??

hi everyone,
my husband has to leave at the end of august as he received a scholarship to go abroad and study, so he will most probably be gone for 2 semesters (he is intending to extend the study). i'm just wondering, IF i get an interview appointment during his leave of absence, what do i do? can i re-schedule it? or go without him, maybe get a letter showing that he has gone abroad for valid reasons? have beneficiaries gone without their spouse?

another thing is: when i printed out the I-485 package, i got four sheets of the G-325A form. but i only filled out one for the I-485 and one for the I-130. then i gave one to my husband and he filled out that one for the I-130. did i do it right? or did i have to fill it out 4 times for the I-485 and another 4 times for the I-130 while my husband fills it out four times for the I-130??

also, i don't have a joint sponsor. i don't have any family here and none of my friends make enough.....and my husband doesn't meet the requirements....i don't work currently, but my husband works part-time and both of us are still studying.....so i used assets....the assets exceeded the 125% requirement by a lot....so i'm wondering if this is ok? will it cause a problem at the interview? have people used assets only, without any joint sponsor? will they insist on a joint sponsor? because i cannot get one, that's for sure!!

thinking about these things have got my heart rate up!!!

For the interview

Your idea of a letter is a good one if you decide to do that get it notorized with his and your signatures, You may have to reschedule the interview with him out of own. I suggest trying to call the USCIS customer service number and ask them about that and your I-864 affidabvit of support question.

For the G325A's

All Four sheets must be submitted with the I-130 for USC & I-485 for Alien Relative
Go online to the USCIS webpage http://www.uscis.gov/graphics/formsfee/forms/g-325a.htm
complete the FILLABLE forms on your computer they will print in quadruplet just fill them in on your computer and print. You each will submit one set of G325A's Submit the I-130 & I-485 together with G325A in quadruplet

uh oh!!

hey thanks for replying to my query
ok now i'm freaking out about the G-325A.
i had printed out all the instructions to the forms and it said on the instructions for both the I-130 an the I-485 that one has to submit "a" form G325-A for both hubby and wife (for I-130) and a form for beneficiary (I-485). so i just presumed it was only one sheet that had to be submitted rather than all four. you think they will ask me to fill in the rest of the forms and re-submit it?? will i have issues over this??

anybody with other opinions/advice or experience regarding this and the other queries?? please help.

The forms print in quadruplet if you fill them on pc,
different copies of your G325 go different places if you look at the bottom of the 4 copies there is a different file destination for each copy, You may get an RFE ( request for Evidence ) they may ask you to submit the G325 A in quadruplet as the instructions clearly state.

If I were you I would go to the USCIS web page open the G325A
http://www.uscis.gov/graphics/formsf...les/g-325a.pdf
(notice the bottom left corner of each form next to page number different file destination which is sorted out by USCIS when they receive your package)

complete the Fillable forms Print them in Quadruplet ( 4 for you and 4 with your husbands Bio info. then RE-Submit all of them to the USCIS. after you print them make another set of copies for your own records!

Include a cover letter explaining what happened and that you are sending these to be filed with your previously filed I-130/I485, be sure the cover letter shows the dates you filed your original I-130/485, your receipt numbers & corresponding ND's & copy of the receipt notice and include your complete names and address. Mail the G325a's with a copy of proof of payment for filing fees and (canceled Check) & copies of any NOA 's you received include as refference. Be sure to send it FEDex or Priority mail return receipt signature confirmation.

That way you can get it to them before they delay your case any longer,

If that is true about the G235As, then I'm definitely getting an RFE for them. I think we sent 3 of those forms altogether. 1 for hubby and 2 for me.

Haven't gotten one yet though, only an RFE for my I765.

I just read the instructions for the I130 again, it says 1 G235A is for the spouse and 1 G235A is for the petitioner.

For the I485, you need one g235A for the immigrant.

Doesn't make sense that they'd want so many copies of the same form! What has everyone else done?

Form G-325A has four pages! 1 copy of G-325A means the entire form. It does not matter that the pages are almost identical. All four pages are part of the form. As someone else pointed out, the four pages differ in that they have different destinations.

Did you just fill out the first page of I-130 or I-485 as well? I do not think so. Maybe you will get RFE, maybe not, but do not say that the instructions told you to just complete the first page of a form.

When you go to USCIS web page to download the G325A under the instructions section of G325 it clearly states:
"1 page, in quadruplicate. Total printed pages: 4"
DO Not print out blank pages! coMPLETE THE fillable FORM ON YOUR PC then when you go to print print all 4 pages! 1 set for USC, 1 set for Beneficiary

They need different copies as there are different filing destinations for each form. Look at bottom left coner of each page next to page number, also notice how the pages are slightly different at the bottom!

(2) Rec. Br. <--
(3) C.
(4) Consolate


Thats why you should read instructions on all forms.

If you get interview notice and all your receipt notices then I woul dnot worry , however if you feel there is a delay then you may want to just go ahead and re-submit them in Quadruplet.

yeah you guys are right

yeah you guys are right...it's four sheets...shoot.....well i think i'm going to have to wait for the RFE because if i send it in again, who knows where it's going to end up?? probably on the back burner. so maybe i should wait...but it is taking an awfully long time for me to get the fingerprint notices....maybe it's because of the G325-A....

in regards to my other queries, does anyone know if using ONLY assets to meet the requirements is ok? they won't insist on a joint sponsor would they?

and what do i do if my hubby is not here when i have to go for the interview?
i especially need to know about this because he's leaving soon.

If your petitioner does not appear for the interview, your application will be considered abandoned. I think you can request interview at a later date but they won't approve your case before they see both of you in the immigration building AT THE SAME TIME ... Scholarships are important but you both should prioritize by importance of things. Have in mind I didn't do extensive research on this subject because it doesn't apply to me and my husband but I do know you both MUST ATTEND THE INTERVIEW.

You both need to appear in person for the interview, no question on that. The interview is for the both of you, to verify that your marriage is bonafide. Like Glorya said, I think you should give this high priority, even if that means that he has to come back for the interview when you get the interview appointment.

As for using assets, are these assets that can be liquidated? I mean, since both of you don't have full time jobs, it will be important to show them them that you, the person who is adjusting her status will be able to survive without depending on the state. Besides proving that yours is a bonafide marriage, it is important to show that you can support yourselves, which is also why they ask you for the tax returns and paystubs. You might want to be careful about this when you go for the interview or your application may not be approved and deportation proceedings could be started against you.

Honestly, I read and re-read the instructions on both the I130 and I485 at least 10 times. It looked to me that they just wanted one for the spouse and 2 for the foreigner. Oh well, if I was wrong about that, oh well. Hopefully I won't get an RFE for it. I got my biometrics done fast enough.

*shrugs* The instructions weren't very clear to me unfortunately. Oh well.

They are talking about sets. One set for the petitioner and two sets for the applicant.
One set is four pages.

Don't worry about it, I think I did it wrong too, and I didn't get an RFE for that. (I got one for something else though...)
I haven't seen a single person yet who got an RFE because they didn't send enough G-325As.

Vaishali, are you on my EAD/RFE list yet?

thanks everyone...

hey guys,
thanks for helping me out with these questions...i guess i'll just have to wait and see about the G325-A. its definetly all four sheets..i wish they had said "set"....but then again most ppl did send it sets...so maybe it was just me....

about the interview...i knew that both have to attend....i had read somewhere though (it was an article about ICE and some investigations they did) where this guy walked in for the interview and said his wife was sick and at home but it like a fraud marriage and they caught him as they saw getting all cuddly with a woman right after he got approved....well maybe this was for a second interview or something or maybe the source needs to be verified!!!!! have no idea!!!
well my hubby got this scholarship way before we even got married...and he has to go this fall semester and most probably the spring too, unfortunately....well i hope i will be able to postphone the interview...i wonder if can choose the date or if they give us one....??!!

the assets are in a savings account right now. and it's above the requirement they need. so i hope it's going to be ok.

I got an RFE for my I485 joint sponsor. They want to see his birth certificate No biggy I just have to ask the joint sponsor for his birth certificate.

i have another question

ok i have another question, this one is about AP.
everyone i know is telling me not to travel at all. my friend's aunt, a friend of my mom's....after which my mom is sending me emails after emails....and she's really freaked out....so i'm wondering if i can really travel. i know that you can get the 3-10 year ban if you have been out of status for more than 180days. so i'm wondering if i am out of status.

i was given F-1 OPT last year and it was/is going to expire on july 31. i got approved while i was in summer school last year.
my student visa expired on june 26.
my I-94 says D/S on it. i haven't travelled since april 2005.
my ND is june 21.
so what does anyone think?? should i travel or not? have i been out of status?
does anyone know any lawyers in the NYC area that is good for a consultation maybe.

So you applied for AOS before your visa expired, right? I don't know what D/S on your I-94 means. But since you applied for AOS before your visa expired you never overstayed and you may travel with an AP. You don't mention in your signature if you applied for AP or not.
It's I-131. You have to apply for that first.

haven't applied yet

yeah i haven't applied for I-131 yet because everyone is giving me mixed msgs about travelling. i applied before my visa expired.
do you know if there is any reason at all for them to reject you at the POE, when you use AP? and also, being on OPT means that i maintained my status right? these ppl are telling my mom that they harrass you at the POE especially since i will be travelling back without my hubby...
