Can I include my mother's income in helping to meet the income requirement for 864?
Hello,
I'm a USC. I'm in the process of filing my wife's GC applications. Me and my wife just recently got married, and we still live in my mother's house. I'm working on I-864, and my income for 2005 was $7000, so it's well below the minimum requirement of 125% of poverty line for a family of 2 ($16,500). My question is, since we (me and my wife) still live with my mother, and her income of 2005 was $18,000, can I combine her income and mine to meet the minimum requirement of 125% of poverty line for a family of 3 ($20,750)? Another thing is, the value of my mother's house is around $600,000 (75% paid off). Can I use this figure in any way to help me pass the income requirement? How is this done? What forms must I submit for this? Thanks |

You can use your mother's income as a "Household" member. But as you mentioned, you will then have to have 125% of poverty line for a family of 3. I believe that you can use her house as an asset.

So, what form(s) does my mother need to fill, if I want to use her income and assets to satisfy the minimum income requirement? |

i think you can only use your mom's house (or the value of the house) as an asset if you are NOT staying in the house i.e. if it's a second home or an investment property or something like that..as the asset has to be available within a year.....you might get an RFE if you use the value of the house, if you or your mom is currently staying in it.
