wondering about inadmissability

my situation is very complicated, but i'll try to make it simple.
situation:
entered the US on may 29 2001, visa waiver program, got married on august 10 2001 (within 90 days of entry), wife didn't file any forms for immigration so i left on september 12 2002 (over 1 year and 90 days of entry).
i'm currently in the proceedings for divorce, but i hope that doesn't matter.
i just want to know if i'm currently inadmissable, and if it will be a problem if i get married to a US citizen and file for immigration.
i'm a german citizen.
any help is appreciated.

Yes, your overstay (the marriage is irrelevant since nothing was filed so the illegal presence never stopped) will make you inadmissible. If you get married to a USC, since you are now outside the US, the USC will need to file a waiver for you. See this forum for lots of helpful people with this:
