Affidavit of Support - I130
Hi everyone
My wife is in the process of completing the affidavit of support form and I would be grateful if someone could clarify the actual paperwork that is required by US Immigration regarding the tax returns. Although my wife has been working in the states for a few years she's never filed tax returns and only did so a couple of weeks ago for all the years she's worked. My question is, does she have to forward some sorte of confirmation from the IRS once they go through the returns, or is it the actual forms she completed or copy, that has to go to the immigration. Copy of her tax returns is all she needs to send in. The recent memo now states you only need to send in the most recent tax year... However, I would error on the side of caution and send in 3 years still since the instructions tell you to and in case you get a dumbxxx who reviews your file and sends out a RFE.

Sometime is right. You can look up more information here:
http://uscis.gov/graphics/howdoi/affsupp.htm#howdoi We only included tax returns for the last two years and I think it should be fine, since that memo really says that only last tax years tax return is needed. But if you have the tax returns for the last three years, do include them. You will also need proof of employment, like a recent paystub, or an employment letter stating how much you earn. |

We'll be going with my wife's earnings as I'm still overseas at the moment (she's a permanent resident not citizen), and employed as a teacher so we have a recent pay slip to forward, together with US property asset details. All the best and again thanks for the quick response. |
