Need Advice
Hi
I have a Green card for the past 30months.Until today after i got my GC, i never travelled outside of the US. Our company is a French Company with an office in the US. The company is traded on the NYSE. My company is now offering me a package to go work in India for 2 years. I will be paid salary in the US as usual with a direct deposit into my bank account in the US. I own a home which i intend to rent out. Since the company pays here, i will still be filing taxes as usual. The thing is.. this is a big career move for me and i really need it. I was looking at the risks and found out that there are 2 ways to resolve the problem 1. I can just take up this offer. My company agrees to provide me tickets to the US every 5 months to stay here for a 2weeks. that way i dont break the continous residency requirement to apply for Citizenship. I intend to return back after 2 years anyway and apply for citizenship. 2. I apply for N-470. So everything is good. But the rules are very strict to obtain this. And i am not sure my company qualifies for this. Can i Go with option 1 and still be eligible for citizenship. I appreciate the help |

My understanding is that the re-entry permit only allows you to come back as a LPR after a prolonged absence.
Also, be careful, any trip outside the US can lead to problems at the border : applying for a reentry permit is a better chance to avoid those problems. N-470 has very strong requirements. Based on your post, you would be ok for the "presence " part. However, your company being french is a potential problem. See the post " Encouraging news for persons wish to work/remain abroad after GC". Quote:
I am also looking for info on re-entry permits ( see my post : 'looking for advice : reentry permit or not ') . Quote:
Following up on what **** wrote at my post is that lying to USCIS is BAD ! ( for you of course ). USCIS could find out that you're only in the US for a couple of weeks a year, which wouldn't be great for your GC without a reentry permit.

N-470 Eligibility
If my company is not US-Based but is still publicly traded on the NYSE.. Does it make me eligible for N-470?
Thanks Srini |
