H4 extension approval

I've extended H1B in April in 2005(expiration 4.30.2005) and got Notice of Approval for H1B. But my attorney and I forgot to extend to file H4 for my wife at that time. - He didn't take care of it so much and I honestly didn't know that I should also do the same thing for H4.
So The problem is that she doesn't have any notice of approval and out of legal status now. Now almost 10-11 months have passed since her h4 and I-94 was expired in April, 2005.
I understand it's too late to try it, but can I apply and get a Notice of Approval for H4 for her at this time? Is there any way to keep her legal status here?
