Birth Certificate RFE

Hi Everyone,

I have a pending I-485 with the NBC through my spouse who is a US Citizen. I had been sent an RFE for Birth Certificate/Non-Availability Certificate by the center (They already had affidavits from my parents). I sent them the non-availability certificate obtained from Mumbai Munciple corporation, which was received at the Lee's Summit, MO address on the 20th of Jan. However I still don't see any change in the status of my case online or even a response to the documents received by them. Is it normal for them to take this long? They issued the RFE on December 14th and my I-485 ND is November 8th. I was thinking of taking an infopass and going to my DO on the 15th if they continue to not respond. Customer Service has no idea about what's going on. Does anyone here have any suggestions/advise? Any help is welcome. Thank you.

It takes a while for your RFE response to be processed (provided you submitted the original RFE letter with your response). Dont depend on online status updates, they suck. If you dont see anything change, get an INFOPASS appt and check on your status.

Thanks so much for the advise. I did send the original yellow letter along with the original "Non-Availability Certificate". I also sent copy of my parent's affidavits along with a statement saying they had the originals. My only concern is that the yellow letter asked me to mail it to Lee's Summit Missourie and I mailed it there. Would it be a better idea to send it to Chicago Lockbox? Don't NBC mails go there?

Arie thanks so much for your reply. I received my interview notice yesterday from the NBC for March 27th. Does this mean my RFE went through? my online I-485 status still says "We requested for RFE". However they don't seem to be updating any info there. Anyhoo, here's my timeline:

June 26th, 2005, Married to USC (Met spouse in college in 2002)
July 10th (Vermont Service Center),I-130 sent
August5th, I-130 approved
October 28th,2005, I-485,I-131 Mailed
November 8th, I-485/I-131 Notice Date
November 25th, Emergency Advance Parole processed at Portland,ME DO due to Father's death. (Departed for India on 30th November)
14th December, I-485 RFE for birth certificate issued
28th December(Was still in India), I-485 Biometrics notice issued for 4th January,2006.
4th January 2006, Biometrics rescheduled to 21st Jan 2006
18th January, Applied for I-765
20th January, Sent Birth non-availability certificate to NBC
21st January, Biometrics and prints taken for I-485 and I-765
13th February, Interview notice received
27th March,2006, First Interview Scheduled

Yep, looks like your RFE was accepted. IF not, you still go to the interivew as the letter tells you and the officer would tell you if you are still missing something.

Dont worry about online updates, they are not reliable. I got my GC approved, but my online status still says "We received your response to the RFE and it is taking us 120 days to process". Forget about the online status and start preparing for the interview.
