Divorce after GC
Hello there,
Thanks in advance for taking the time to read and hopefully answer my question. I just recently got conditions removed from my GC and now have a permanent one. We have 3 little kids together and I love them more than anything. They're both US citizens just as my wife is. My question is: What would happen if I, hypothetically, wanted to get a divorce from my wife? What are my options here? BTW, I am from Bangladesh originally, not that it should really matter. I understand that there doesn't need to be a "reason" for divorce and that one could always pull the "Irreconcilable Differences" card. Is that so or do you REALLY need to have a specific reason? So how would I go about getting a divorce and will my wife HAVE to sign the papers in order for divorce to be finalized? Sorry I am very 'law-illiterate'. After the divorce, what happens to my GC? Do I get kicked out of the country or continue living here. There is another female US citizen who takes a strong liking to me and I like her too. Although we are both married at this point but there is a possibility that if one gets a divorce from their spouse, the other will follow suit. What would be the best course of action at this point, without eventually getting kicked out of the country. Also, if I did in fact go through with divorce, will that in any way affect my eligibility for US Citizenship even though I still have a few years to go for that? Thanks very much for your kindness and willingness to answer my questions. I appreciate it! A Bangali Boy |

Hello, “AngelGirl”!
Your worries about GC is over. You removed the condition, you have your permanent green card - you are a fee man now. Free to work, free to travel, free to divorce and free to remarry. You won’t “get kicked out of the country” unless of course for a serious crime. As to your US citizenship – you are still eligible of course. The only thing is – if you were still married to the person, who sponsored you for GC, then you would wait 3 year to apply, if you get divorced – then its 5. About a divorce… there has to be the reason, no judge in her/his right mind will divorce two people with kids without a reason, but “Irreconcilable Differences” might do, depending on your state law. Also, your wife will have to sign those papers as well. And since you have kids together, then it won’t be a simplified divorce for you and there are going to be a lot more papers to fill out and sign, then you can imagine. Please consult the divorce attorney. Good luck! |
