H-1B Renewal

Hello:

My application for H1-B renewal reached VSC on August 8, 2005. The first 3 years of my H1B will complete on December 31, 2005. Today its December 22, 2005 and VSC has not given any decision. My questions are:

1) Would I be elegible to work at my current workplace if I do not hear anything from USCIS until December 31, 2005?

2) Would I be out of status after January 1, 2006?

I called at (800) 375 – 5283 but it doesnt provide any more information than what is there on the USCIS website.

is there anyone else who applied for renewal in the same time frame and have/haven't received the decision??????

As long as you have a timely filed (ie before the currrent one expires) petition to extend your current status, you can continue to work. You will not be out of status unless you leave the country.
