I130 Approved - Confused by Priority Date

Hi all,

I'm probably the only one that isn't clear as to the procedure with the category 2A priority date. I understand that the numbers are limited and that only those with dates earlier than the dates quoted are eligible, but could someone please expalin two things.

When they refer to "priority dates beginning 15DEC98 and earlier than 01JAN02." Are they referring to the notice date on your receipt notice, I797, as the priority date is blank. If not do your know what they are referring to.

Also, the following is stated "2A numbers SUBJECT to per-country limit are available to applicants chargeable to all countries"
How do you find out if your country limit has been reached, as I can't see that mentioned anywhere.

I located the above information on the US Department of State web site

Answer

Your receipt date is your priority date. You must send an approved notice with other applications after your priority is current. If your I-130 is pending, you only have a NOA with a receipt date. Notification date has nothing to do with priority date.

You don not have to worry about how the DOS calculate the cut-off dates. As long as your priority date is earlier than the cut-off date under the country of your origin, you can file I-485. Mexican citizen is eligible to file if s(he) has a priority date earlier than Dec 15, 1998. All other countries is Jan 01, 2002.

Thanks for your response

My wife has now scanned and emailed to me a copy of the notice of action recently received and I can see that the priority date is quoted, and is before the current cut off date. I believe that the process is now different for me, as I am currently abroad and I understand that I now have to wait for my consulate to contact me, as opposed to filing the I485.

I would be grateful if there is anyone who has been in the same position and can advise if the next contact will be an interview or is there another stage before this.

Again, good luck to everyone going through this process.

You wife needs to call the National Visa Center to start your immigration process. The NVC will guide you step by step what to do. Once the NVC finishes processing your case, they will move it to the U.S. consulate in your country for an interview.
