can a GC holder work as a short term-contractor with host company as canada

Hello

If a company has operations both in US and canada and if there is a position advertised for a short term contract in US for the employees in canada.
can a GC holder apply for that position.

he would be inside the US working but his payroll will be in canada.

so a PR with permanent residence in US. car license, bills etc in US. but payroll in canada. working as a contract in US

i was thinking about the whole- u taking employment in foreign country thing.
since ur payroll is going to be there. there will also be a work permit in canada.

i know this is not easily answerable ( will try to contact my lawyer).

p.s: yes payroll wont be in US. but it will be in canada. as this will be employment in canada- but physically present in US.

its kind of weird but in large companies they have weird rules too.
for example in this compay they have hiring freeze in US but not in canada. so the depts (in US)that need people try to get people on contract from canada.

If you are a contractor working for a company in Canada...then you can be considered self employed in the US.
All you do is send an invoice to Canada for your services.

thanks for the answers.

yes it would be an intra company transfer/contract. and yes the tax returns would have to declare this as "foreign earned income".

do the USCIS come into picture at all. For example does the companies have to tell the USCIS that they are bringing in a contractor from canada?

only thing is when u actually travel across border - got to be careful not to answer that ur employed in canada voluntarily. ( when push comes to shove - i understand u cant lie - so will have to tell the entire truth)


would like to get more answers from other members who have experienced/heard similar situations also. ( any opinion is welcome)
