How to get the H1 Documents from Employer?

Hello:
My employer was not able to find a job for me and now they won't give my H1 papers unless I give them $5000 so that I can transfer my H1 with some other companies. I need the papers since I have to go to India and get my H1 stamping.

Is there a way I can get the copy of H1 by some other means?

Explain your situation more.

Are you currently on a H1B Visa and in US....

I did my bachelors in US and the consulting company applied for my H1 and they promised a job also but they never cared.

Does that mean you are trying to go in H1B from F1 and this consulting company filed your H1B?

Yes, I was on F1 and my H1 got approved recently and need to go to India for an emergency but my company won't give the H1 papers without $5000.

What is your current Visa status. If F1 until when it is valid?

F1 visa is over and OPT period is also over.

Well, does that mean that, your visa status as of now overstay? If yes, you have to leave the country in order to have good records in US. The time period for applying new H1B for the current year is already over otherwise you could have asked another company to file your papers and start working once you have got the receipt number.

I am sorry for you, looks like you have to get the papers from the current company who got it. Negotiate with them that you can stay with them for two years but without paying money, if you dont want to pay the money now.

Another Idea, do you happned to know which attoreny or law firm filed your pitition? in some cases you could get a copy from them also (for a small fee).

If you dont know your attorney, send me a private mesg with your company name, I could probaly find out for you.

If you want to post your company name to every one that would be great, because others could be aware.

Remember that the approval papers alone is NOT ENOUGH for stamping. You need a lot of other supporting documents. Better consult an attorney. Good luck
