V visa for spouse, Filing in Oct. 2005

Hi,
My wife is coming to the US on H1b soon. I'm a GC and want to file her on I-130 to process her as my dependent. Does she has to maitain her status on H1b separately? If she doesn't work, can she be considered as illegal? Does INS gonna issue a notification for V visa after 3 years, even though she'll be here in the USA? Does INS still issue V visas for the cases filed after 2004?

Yes, she has to wait until your case PD becomes current in order to apply for EAD.
If she does not work, what is her status (illegal)? H1B= working.
No V visa after 2001, unless new law comes out.
