Priority Date recapture in CP

My CP with EB2 is being processed by NVC. Pckt 3 recived on 09/14/2005. My attorney doesn't think that I can complete consular interview in Montreal before 10/01/2005 when PD retros to 11/99 for Indian Citizens. I have an old I-140 approved (LC sub) from a previous employer. My attorney thinks it may help for AOS but he is not too sure if it can be used by current CP? Any advise? Rajive Ji see if you can express your opinion on this?

R you using the previous I-140 from previous employer or thru labour substitution

Its I-140 from previous emplyer based on LC SUB. Current I-140 is on RIR LC.
