What is the prioroty date for a labor substitution case ?

What is the prioroty for a labor substituion case ? Is the original priority retained ?

This is an approved EB2 substitute labor from 1998. Plan to use that to file 140/485.

Its supposed to be retained as 1998. Good luck. Hope your substitution case goes through 140 without a problem.

The requirements in the original LC were pretty trivial - MS + 0 years experience

if the company has origianl labor, jump for it

if not then make sure about the company credentials,it would still be worth taking it, I would go ahead with it almost 100%. whatever you give/trade off for it should be well worth

Original beneficiary retains PD

I was doing a research on this and found the following doc:

According to this, the original beneficiary retains his PD. The new alien to whom the labor is getting substituted will have the priority date as the date on which 140 is going to be filed.

Let me know if I am wrong.
Even my company is ready to do a labor substitution. The priority date is June 2003. Undergraduate + 1 year exp.
I graduated in Apr 2003 (1-year worked while doing graduation) .
Is there any potential for fraud in this case......
