Angry retrogression : Priority date 2000

Hey all,

My priority date is september 20 2000 . I filed my AOS in
April 13 2005 and did recieve my EAD and AP.

Now due to retrogression which starts as of October this year
can anybody help me understand what would happen to
my case which is pending? Will they stop all work on my case
starting October 2005 ?

What matters most in my case the April 13 2005 date or my
Prioirity date ?

I appreciate any response and I appreciate your time.

This is based on PD. You may get FP notice if you haven't recd. yet. Becides that there will be no processing.

Thanks for your reply. I was also wondering at some posts
mentioning that Jan 98 which is the PD date as of October
may move quickly.

I was not sure the basis of that reasoning. If any body as
special insights to it .Please feel free to share.

you really haven't lost much due to retro

it could have taken about 1 yr+ without counting any current happenings, even now it is about the same for you. go relax, have vodka, tequila and wakeup after few months, your are one of the lucky ones..

Question Priority Date is not the only Criteria

Priority Date is not the only criteria. Your AOS notice date is also important.
For example, VSC is processing AOS cases as of Sept 2004. This means that VSC has started to work on cases which were filed on or before Sept 2004.

Let's take this scenario. Assume that EB3 is current and AOS is April 2005 ( as is your case). This means that Visa number is avaliable for you, but VSC has not yet got to the cases after Sept 2004. ( there are exceptions - but generally this is the case).

My point is, even if the priority dates move to sept 2000, VSC dates has to move to April 2005 for your case to get processed.
Again if the VSC dates move to April 2005 , but the PD is not current for your case, what happens is that, they will process your case and put it as pending until visa number is assigned to your case by the National Visa Center.

Check out the National Visa Center website for some insight.

This is my understanding ....

May be Mr. Rajiv Khanna can throw some light on this matter.

if you are a pgmer this will be a looping around, think outside the bun, no longer ND

has a real meaning. it is essentially PD. That argument could hold grounds only when visa on current scenario, no longer true for retro, otherwise they will keep processing 98 cases forever..and never move forward as old cases keep coming from BRC say a case of 98 came today, so they will wait for 1 more year to touch it, come one these days many people got approved in 3-6 months..
