I-140 and EAD??
If NIW I-140 is filed after October, gets approved, and if priority date for India is still not 'Current', can one file and obtain EAD without filing I-485?
Thanks. |

I guess, One can apply for EAD only when 485 is applied, and 485 application needs PD to be current.
I would like to have confirmations on it, if there are any exceptions, i would be happy to learn them too. |

Shankyyy,
As far as I know, you can only file for EAD with the I-485 application. |

Thanks, all for the clarification. So I assume, the only way is to get H-1 extension beyond 6 yrs, which I think can be done after I-140 approval.

Not really. You can get 7th yr extension if your lc is filed 365 days before your 6th year end. It does not matter if it is approved or pending
