Can spouse in H4 buy my company?

Any advise would be greatly appreciated..


I'm a H1B visa holder in my 7th year extension. My GC process is in the Backlog Center. My employer (ABC inc (LLC)) is downsizing & thinking of closing down.. They are mostly in operation only as a favor to me for my GC. My client, (DEF Corporation) wants to hire me once I get my GC, which is ok with my employer.

Recently, ABC has been in a situation that he wants to close down his business. As this would jeopardize my GC process he has agreed to sell his business to someone instead so that my process would not be affected.

With the situation as such, would I be able to buy ABC (LLC) under my wife’s name (she is in H4)? Will there be any effect in my GC process in any way (all stages)? She will not work but only be a passive investor. ABC would be still managed by the existing management and remain the same in every other sense. Only the ownership is changing. There would be no dividend or profits pay out during this period.

Any advise anyone?

Is there the possibility of talking with DEF corp. and asking them to take over the process and become the sponsor in your employment based permanent residency application?
