Name change in Green Card and passport for my son

Hello,

Me, my spouse & my son got GC last year .

My son is born in INDIA & his last name is my husband's middle name and it is very difficult to say. I want to change to my husband’s last name. His pasport need to be renewed by Jan 2006.


May I know the procedure to change his name in INDIAN Passport & Green Card??

I read that I can change the name in the county court. But when I called the passport office they told me that change of name should be published in any local paper in India. Is it so?

Which passport office did you call? In India? If so, they will give you the Indian version of name change procedure.

But in USA, you need only local court order. Once your son changes name in court, you should contact nearest Indian consulate and apply for new passport there. For green card you need to file I-90 form to get new card.

Yes even though you have court decree for changing the name you need to give newspaper posting in india to get Indian passport from indian consulate ..

b) Change of name NOT consequent upon marriage (new passport issued with new name)

What are the requirements/ documents to be submitted?

i) Completed application form for new passport

ii) Original existing passport

iii) 4 photographs (preferably in colour, front facing, 2" X 2")

iv) Court Order or Sworn affidavit in the prescribed form – Affidavit for Change of Name , giving both names, duly notarized by a Notary Public.

v) Original newspaper clippings of the Notice for change of name in the city of domicile in USA AND in India (2 notices-one local and the other in India).vi) Copy of Green Card (both sides, enlarged clear copy) or Employment Authorization card (clear enlarged copy) or legal/ visa status such as HIB etc.

vii) Fees of $ 20 for new passport

viii) Mail back charges (preferably $15 for return by overnight mail which is more reliable and safe. Consulate can not take responsibility for delay in receipt or loss of documents sent by certified mail. No self addressed envelope necessary. Fees for passport + mailing charges can be sent together through a single money order or cashier’s check. Please note that payments by mail can only be made through money order or cashier's check in favor of the Consulate General of India.

I called the Indian consulate in NewYork. They only told me that name change should be posted in Indian local news paper.

Thank you for the information.

I was trying to find out whether there is any possiblity to avoid the Indian News paper notice. Looks like can't escape from it.

If you plan on becoming a US citizen, after you become a US citizen, then change the name of you child with a local court process, and apply for your child's US passport with a new name!

Hi Dicky,

I need to change my daughters name or otherwords adding my inital to her name also (by INDIA rules). Now her name is Sona K (India) & Sona Kalidas(US).

I changed her name as Sona U K in indian birth certificate & but i need to change in GC & INDIAN passport also as her name is Sona kalidas now.

Did you changed ur name for ur son via US court house? May i know the procedure also?
If we are filing a name change in local court house, whether parents & child need to appear on the hearing date?. What if one parent does not appear for the hearing? Will they deny the application?

Did u changed ur sons name in GC & Indian passport. If so, can you let me the procedure for name change?

Hi,
I'm in the process of changing my son's name. I applied for the change of name in the pasport. For passport they need 2 ads in the news paper(one in India and one in US). I have not got the passport back. To change the name in the GC, you need court order from US. That also I have just applied in the court. They have not called for the hearing. I do not know whether they will deny if one of the parent is not there during the hearing process. In my county it takes 8-10 weeks(as they said at court) to calll for the final hearing. So if you can wait till Feb, I can tell you exactly what to do based on my experience. Meanwhile, if you have any questions, let me know.

Could you tell me how did you change your daughter's Birth Certificate in India? What is the procedure for that?

Hi,

My Father did a name change in INDIA with her original birth certificate. My case is adding my initial to her name.
like Sona U(ma) K(alidas) instead of Sona.

If u want, i can get the procedures.

How much is the fees to petition a name change for minor in US Court House?
I also saw that both parents need to be there at the time of hearing or they need other parents concern if they deny or cannot make it for hearing.

Did you & ur hubby went for the hearing first time?

Hi,

The fee for the name change in the court is 256$. My son's name change is still in process in the court. We have not heard any hearing date from court. I got the passport with the changed name. Waiting for the court order.

Can you please find out and let me know the procedure for the change in name in the Birth certificate in India? That would be a great help.
