Hello Everyone!

I been in the country for 9 years, Im from Mexico, City, I came in a B1/B2 visa, I was able to travel to my country, but about 3 years ago my !-94 expired I couln't leave the country on time, 1 year later my visa expired, I was afraid to leave the country and I decided to stay here. Now I just got married with a USC, I have a social security that says "Not valid for employment" but Im been working with that number, also I have a valid Drivers License. I think Im in Default (Ilegal) because my inmigration status. My wife and I want to fix this as soon as posible so we can travel to with me to meet my family. please tell me sugestions and which options I have, how long Im looking to fix this, I don't know about all this process. which forms to file, see if we can do it ourselves without an attorney.

Thanks to you all!

Your wife must file an I-130 petition for you and you must also file for Adjustment of Status. Given that you've been out of status for awhile you really need to talk to an attorney. If you've been out of legal status for more than 180 days since you got to the US, you should not leave the country until you have adjusted your status. Otherwise, you will be barred from re-entry for anywhere from three to ten years. Again, I suggest you and your wife talk to a lawyer.

that's right. Do not leave the US until you get your GC, otherwise, you will be banned from entering the States for 3-10 years, depending on how long you have been illegal (more than a year = 10 year ban)
