I-485+I-130 Rejected; Question

Folks:

My wife (USC) petitioned for her mother for GC. It was rejected with the following reasons:

-"Proof of USC status of petitioner. submit copies only": She included a copy of her US passport. Do we need to include additional (such as naturalization certificate) documentation?

-"Fingerprinting Fee for $70". We missed this and included $25 (old fee) instead. I assume she needs to send $70 bucks instead of $25.

She need to include either a copy of her "birthd certificate" -fi she is born in US or "naturalization certificate" to show her citizenship.

Yes, you will need to include the new fee. Good luck.

Hi Ken:

Thanks for the response.

Now we are resubmitting the I-485+I-130 package. For the very first time, it took about 3 months for them to open and review the package.

My question to you and the kind souls out there in San Jose is: How long does it take this time to open and review the file? As it was submitted once, does it take priority over a new application filed at the same time?

Your process will start all over again because the application was rejected. If you would have submitted the correct fees, they would have accepted the application and would have asked you for RFE (Request for furher evidence). Unfortuantely, its their policy to reject all applications with incorrect fees therefore, yes, your process will start all over again
