Urgent Issue Regarding Estranged Husband, Overstayed Visa Waiver, Reentering

I hope someone here knows the answer to this. I know it is probably on the opposite side of the usual posts here, but I need help!

My then-fiancee entered the US on a visa waiver, and we got married over 3 years ago in the US. He accrued unlawful presence in an amount of almost 3 years, never having adjusted his status. He only left the United States (willingly) in June after he made a threat to abduct our one year old daughter if our marriage failed, and my sister called the police out of worry for me.

Recently, he has said that he will be coming back to the US in January 2005. My question is this: will he be allowed reentry into the US? I am afraid that if he is allowed to reenter that I may never be able to make him leave, as he refused to leave the last time without my daughter. He took her with him last time and I actually had to go to the UK and physically take her back from him with the police present.

Please tell me exactly who I need to talk to regarding this. I know that THEORETICALLY he should be barred from reentry, but in actuality, is he red-flagged and marked? And what do I need to do to find out specifically?

Please help me to find out this information if someone can. I am tired of worrying about what will happen if he shows up on my doorstep.

Are you a criminal if you never get caught?
Similarly he will be allowed entry into the US if he is not caught. The best option for you is to get a restraining order against your ex-husband from the court. If you do not have means to get it yourself, I suggest you seek help from abuse centers near your.
