Question Any time limit for getting passports stamped?

Friends,

I recently received approval notice for my I-485 adjustment of status application. I and my family members are now required to go to local USCIS office for getting passports stamped with new status.

My question is "is there a time limit for getting passports stamped after approval notice date? If there is a delay, say over a month, do they have to give any letter to any authority asking for time?".

I ask this question because my wife and daughter have gone to India and are scheduled to return in February 2005 - that is over three months after approval date. Is it necessary for them to come back early and get this stamping done within a certain time? Can USCIS interpret the delay to say that they have abandoned the application?

Please guide me. Travel to and fro is lot of hassel and expense during this busy period.

Thanks **** for your opinion.

I am writing again to inform group members of my experience. I had posed this question because my attorney had threatened me that not going to USCIS office immediately may be construed as abandoning and hence my wife and daughter should come back from India atleast in December and finish this work. He also wanted me to chose between the green card and a couple of thousand dollars spent on airline tickets.

I subsequently called USCIS 800 number and the person answering the call said, that there is no time limit and they can go to the office on their return.

I visited Denver USCIS office yesterday and got stamping done for me. The immigration officer, on my enquiry, also confirmed that there is no time limit and it is OK for my wife and daughter to visit them in Jan / Feb when they return.

I hope this helps some one in such a dilemma.

What bothers me in this situation is the following part

This turned out to be completely false. Aren't the attorneies supposed to help us

They are. Some just aren't very smart. What other job can you charge someone $250/hour to say whatever you feel like, and get paid even if you're wrong?

Now I know why my mother wanted me to go to law school.

I'm in the same situation. My wife will come back in late Dec with AP and GC was approved one day after she left on Nov 18. Lawyer advices to get her back ASAP. lawyer even told me that she had handled 2 cases where it took months to resolve. I called USCIS and they said that it should be OK for my wife to come back on AP after 1 1/2 months. Let's see what happens.

I'm in the same boat as yours, actually I raised similar question in other thread and was guided to this thread. My attorney recommended my son should come back ASAP but OK to wait longer if no choice. So, according to your guys' suggestion, experiences and calls to USCIS, we should have our stampings done and have my son's done when he comes back in Jan/Feb 05. I am in LA, CA area and please keep posting if you have new informtaion regarding this issue, guess we are "lucky" to have the approval ahead of our original expectations.
