A Tax Question Related To Immigration

Hi All,

Here is a question about "Tax Status" of permanent residents with spouses not in USA and waiting for their immigrant visa number backhome.

In above mentioned situation, if the permanent resident files the tax as a "married person" tax status, he would not be able to file the income tax for spouse as he/she is backhome and does not have Social Security number too.

Now the only option left (to my knowledge) is filing tax as a "Single Person" Status.

What should be done in this situation? As the spouses are supposed to show the income tax returns of their sponsors during the immigration visa interview; Will it cause any trouble if the tax return say the Marital Status of sponsor as "Single"?

Any Suggestions?

Your best option is actually "Married Filling seperately"

Thanks, but even if you file as "Married Filing Separately", you are supposed to provide the Social Security number of you spouse, which in this case wont be available until the spouse comes to USA.

Most of the online application procedures ask the Social Security number of the spouse in all "Married" cases.

Suggestions?

Just call IRS and check with these questions. they are surprisingly pretty helpfull.
