Need H1 Transfer Info Urgently.

Hi all,

I had my H1 transfered from a CompanyX to CompanyY

Now this is currently in process(In vermont center). My visa with comapny X has expired on April 2004. I've got another good offer now from company Z. Can I do a new H1 transfer with the new Company Z. What are the documents I need. Do I have to wait till the process of company Y gets over? Or can this happen parallely?

I was in a similar situation two years back.

Things were different then - you cannot start with the new employer until the approval is done. But now you may start working as soon as the filing for H1 transfer is done.

So I dont know the consequences if you already started with company y in which case you have to provide the pay stubs from company y as proof ( to transfer to company z from y)

If you have not started with company y and still waiting but have a valid pay stub from company x ( say less than 15 days old) - you can still try for a parallel H1 transfer and the one with the latest date will be the one that is valid.

Please check with your attorney for other hidden things that may be applicable.

Your case is a bit critical because your I-94 has expired April 2004 and you are considered on status if you are now working for company y. If you are going to file a transfer now you need papers from company y (which is still pending). I believe you cannot use company x's papers since it is already expired. I suggest to wait for the papers from company y and then do a transfer to company z. better consult a good lawyer.
