EAD/AP (paper based) cover letter and checklist...

Modify as needed, this worked for me. Got approval in 35 days


Cover letters for filing paper based EAD renewal and AP together in same envelope, but each app separated by it’s own cover letter:

Main cover letter

EAD cover letter for primary applicant
Documents for EAD renewal for primary applicant

EAD cover letter for secondary applicant
Documents for EAD renewal for secondary applicant

AP cover letter for primary applicant
Documents for AP for primary applicant

AP cover letter for secondary applicant
Documents for AP for secondary applicant


Note: AP checks were favoured to “US Department of Homeland Security, EAD checks were favoured to “Immigration and Naturalization Service” and write the “A” number in the memo section.

Yes -- EAD is 175 and AP is 165.

Also, I've made all checks payabe to USCIS -- and it worked....
I guess at this time they are accepting all kinds of variations on that (INS, DHS, BCIS, USCIS ) - so cool

EAD Current Processing time

I filed for 1-485 and I-190 today (Aug 04,2004) at Nebraska

My H1B expires on Oct 8,2004
and which can be further extended by 5 months for full six years.


Is it possible for me to get EAD before Oct 08.

What do you suggest.. should I apply for extension...

Always keep EAD only as a second option ... If you can maintain H1 status, its safer to do that.
So go ahead and file your H1 extension immediately.

In case your 485 gets denied, you will be in H1 status .... otherwise, you are out of status and need to pack bags soon.

BTW, what is I-190 ?

I understand one should maintain H1-B status while I-485 application is pending. But if you near to 6th H1-B limit (or you are on 7th year extension), I don’t see a big advantage of extending H1-B. What are your options if your I-485 gets denied (chances are very rare) and you are on near to your 6th H1-B limit (or on 7th year extension)? You can’t file a new greencard application or you can’t change an employer on H1-B if you are on 7th year of your H1-B.

Yes I think I should continue with the 7th year extension... I thought intially that I will save some $$$ by not filing for the same.

From what I heard from my attorney, you don't have to give justification for a multiple entry AP these days.

I applied for a multiple AP in June (did not give any explanation) and I've gotten it approved (waiting to actually get it) -- so it works ( atleast in my case ).

Don't understand the logic!! My previous EAD was valid until November '04 and the renewal is issued from Aug '04 to Aug 05!!! First they want you to apply in advance and then they take off few months, even before I can rest, I have to start thinking about applying for renewal in couple of months again, what a wast e of time, effort and money, when will USCIS get any sense!!!

I assume you would have submitted G-28 when you filed 485/EAD/140 first time where you will say the lawyer represents you.

When u applied renewal EAD urself, did you submit G-28 or did you represent yourself?

If you did represent yourself, how does it affect 485(does the lawyer still represent you or you represent you for 485 also)

I did not file any G-28 for the EAD renewal. But that's a good point, I will have to check. I think the lawyer still represents the 485 app since G-28 was filed with the 458 application.

I don't think EAD renewal and who represents you on your I-485 has any significance. If your lawyer renewed your EAD then if would have to refile G-28 for your second EAD. Correct me if I am wrong.

is it necessary to submit copy of birth certificate? it's hard for me to obtain one right now. or would color copies of passport bio and DL do the trick?

It's not a mandatory document, at least for EAD. So you should be good. I had sent everything so they don't issue an unnecessary RFE.

It is very helpfull. Although I have question, you have mentioned in your checklist for seconday applicant: • Copy of front and back of I-94 arrival/departure card and latest H1B approval notice.

I am thinking it should be copy of latest H4. Please correct me if I am wrong.

Advance Parole Question

Guys,
I have few doubts about this application of AP I am trying to get off my way.
1) Part 2 (Application type) - Is my Option "d". (I am applying on 485 pending basis and this is my first AP)

2) AP application has lots of columns that don't concern us. What is the good practice? Leave them blank or mark them "n/a"?

Hi..Im just waiting for my LABOR CERTIFICATION to get certified after that i can apply for EAD and AP.Sorry for the basic questions i really want to know i dont have a clue.

Just wanna ask you how did u FIRST apply for EAD and AP?
What is the requirements?
What office do i go to INS - Application Support Center (ASC)?
What forms do i need to fill up?
Can you guide me thru this im so clueless. Thanks I appreciate it!

First EAD and AP for the dependent by myself ?

Hi,

Thanks Joyd for such a detailed info. Extremely useful.

BTW, All I read in this thread was for the renewal. How about if I want to file EAD and AP for my wife without lawyer for the first time not a renewal ? Do I need to do anything special ?

Basically company refused to pay for the dependent expenses and the lawyer is too costly so we are planning to file it oueselves. Anybody has done it before ? Please advise.

Appreciate your help a lot.

Basically it is the same process. You can use commensense and send same documents and letter. Just cut out words and documents that refere to 'Renewal or Previous'.

Why Birth certificate need to be attached for I-131

Joyd,

For Principle applicant and Spouse, why Birth Certificate is to be attached? For Dependent son/daughter, I understand the requirement.

Please let me know what is the basis for this.

FP for EAD

Please advise me !

I know the FP and photo taken are necessary at service center in case of E-filing.

Is FP still necessary although EAD filed in paper with I485 and (2) photos mailed as well? This is a refiling of I140/485.

Yes, you can without a lawyer.

E-filing is not difficult at all, just provide your I485 receipt number for reference. You need to call USCIS and make an appointment for FP and Photos after sending out your E-file. You may find the details on the instructions of E-filing at USCIS website.
