LCA and H1 : please clarify (Jaxen/Ginnu)
I am with Company A. Company A has a contract with Company B. Both Company A and Company B are in New Jersey. Company B has contract with Company C which is in Connecticut. Company C places me at a client site which is currently New York City. The client would move out the team to their New Jersey location in 4 to 6 weeks time.
My salary is paid by company A, which has LCA for my H1 in New Jersey. Do I need to file an LCA for New York city? or is it Ok without one? if needed, Is it an ammendment to my H1B? I just got my H1 extension papers.

You need to apply for LCA where your end client is. LCA is not state wise but 'district' wise. e.g if you work in South Brunkswik in NJ, you would have to get LCA from North Brunskwick office. If you moved to Long Branch. NJ then you would have to get the district where it falls. Lets say Company C placed you in Buffalo,NY then your company should file for your LCA from Buffalo,NY. Each county in USA governs how much minimum wage its resident must receive and our employer should fulfill that requirement to get LCA. |
