Getting brother to help in business

I am planning to buy a seven-eleven franchise but dont have enough time to run it as I have a full time job. Can I get my brother from India to help me run the busuness? He has a lot of such experience in India.
Basically can I sponsor him for a H1 or L1 visa in this case?

Thats the legal answer !

But if your brother has a degree you can try a H1-B for him through a company you start for a high skill job and pay him through the company...But there is only a 50/50 chance the h1 get approved

But i think it will be convinent and less expensive to hire a local guy than to go through the above trouble...

This clearly constitutes immigration fraud.

Why is it illegal?

My understanding of legality (as applicable to this particular case) is that if the INS has provisions clearly advocating against the use of this exact scenario, only then is it illegal. Otherwise, it is simply a special case.
