Incorporating a company on EAD

I want to incorporate a company and have an EAD. I140 and 485 are still pending. I believe that only permanent residents can incorporate a S corp. Would I quilify as a permanent resident given that I have an EAD, and the I140 & 485 were filed in Marcg,03 and waiting approval.
I spoke with a CPA and he didnt know much about it. Said as long as I have a SSN I should be ok.

Thanks ****. That is what I thought as well. I think I'll go ahead with an LLC instead at this point.

Advice pls

Hi,
I am working on EAD for a software company.
My wife has also got an EAD. She is a home-maker now.
1. Can she start a consulting company (service industry)?
2. Can I help her in marketing during my off days and not get paid? Bcoz, eventually the profit comes to family.
3. What is the best option INC or LLC?
4. Can she sponsor H1s and transfer H1B who work here?
5. For this H1B transfers, do I really need a attorney, Can I do it myself?
5. Also, to open a company do I really need to go through third party to open a company, Can't I go directly to the local Small business center and fill their applications.
6. Shed some lights on the Tax filing for the company. Does she needs to file tax even if she didn't earn anything for a particular year?

Business Gurus, please advice. It will be a great help for a starter.

One Last question, one of my friend told me that a new company cannot have H1B employees initially rather it can hire such people only after a year of existence?
Is it True or False.
