Can I leave if the employer doesn't want to pay me the salary stated in my Labor Cert
Hi,
Below are my two questions needed your help: 1.) My I-485 was approved almost two months ago, but my sponsoring employer has not paid me the salary stated in my Labor Certificate. Can I ask them to pay me that salary? If they are not willing, is this a good enough excuse for me to leave my current employer and seek a better job without staying with them for 6 months? Any risks for me? 2.) The six month period starts from the approval date or the passport stamping date? Thanks a lots in advance! |

Q133 If the employer lays-off the employee to avoid payment of the agreed or the promised salary (as stated on the Labor Certification or the Job Ad.) A133 You may have a problem. confused
I am very confused. As far as I understand,
the 180 day rule for changing employer is counted from the filing date of 485. Do we also have to stay with the employer for 6 month after the GC approval??? what if we do not? will they revoke the GC???? |

Another question. how does this affect national interest waiver. what if I change job which is not in the same field as claimed in the I140 application shortly after I485 get approved. do u think that is a problem (maybe affect future citizenship application???) Thanks |

I've heard about the need to wait for 'n' number of months before quitting your sponsoring employer and taking up a new job. My lawyer says there's no such thing and I can consider taking any job I want (in any field). On the other hand, from some posts on this forum and from murthy.com, I hear about waiting for 6 months. My question is, five years down the line, at the time of citizenship application, how does USCIS track when and with whom I worked since I got the GC? |
